A porn star has filed a lawsuit against President Donald Trump on Tuesday to have him admit that a “hush agreement” over their alleged affair is null and void because he never signed it, documents say.
Los Angeles lawyer Michael Avenatti posted on his twitter account a copy of the suit filed on behalf of the porn star Stormy Daniels, real name is Stephanie Clifford.
The suit alleges th e hush agreement is not valid because Mr Trump never signed” the document with a Superior Court of California stamp,
It alleges she had an affair with Trump in 2006 to 2007, which she threatened to make public after Trump won the Republican Party nomination for president causing several women to allege engaging in sexual activity with him.
Trump’s lawyer, Michael Cohen prepared a non-disclosure agreement and attached it to the lawsuit and requested a $130,000 payment to be wired from a company known as Essential Consultants LLC to Clifford in return for her non-disclosure.
Using false names such as Peggy Peterson and David Dennison, Clifford and Trump signed the agreement, along with Essential Consultants.
Some days to the November 2016 presidential election which Trump won, Clifford signed her name to the document, as did Cohen for Essential Consultants, it says.
“Mr. Trump, however, did not sign the agreement, thus rendering it legally null and void and of no consequence,” stated the said document detailing the grounds for the legal action.
Cohen in a chat with the media last month admitted to paying Clifford $130,000, an act which instigated her manager to declare a breach of the non-disclosure agreement. .
Trump’s lawyer refused to give his reasons for the payment and whether the President was aware he made such payment to Stormy Daniels.
