The House of Representatives has maintained that the Kogi State House of Assembly will remain under the National Assembly despite a sign filed at the Supreme court challenging the leadership and control of the Assembly.
On April 29, the Kogi State government imitate a suit challenging th decision of the House of Representatives on March 9 to hand over control of the State House of Assembly to the National Assembly.
The decision, brought about by invoking Section 11(4) of the 1999 Constitution (as amended) was according to the National Assembly necessary in order to avoid a complete breakdown of the State House of Assembly.
The National Assembly maintained also that the move by five out of the 25 members of the House to impeach the Speaker was against the Section 92(c) of the constitution which required a two-third majority for such a vote to be passed.
The Kogi State Assembly in its suit how her countered the National Assembly’s move adding that it was in breach of the same Section 11(4) invoked by the National Assembly as the National Assembly could not prove with evidence that there were any security breaches.
The Kogi State government in its suit said: “There is no security report by the Governor of Kogi State (Yahaya Bello), the police or any security agency in Nigeria that the disagreement among members of the Kogi State House of Assembly caused insecurity and danger to public safety in the state.
“At all times material to the passage of the resolution of the National Assembly to take over the Kogi State House of Assembly, Kogi State was and is calm and peaceful as citizens go about their lawful business.”
