A court case led to another court case in Osun state when, police prosecutor Sergeant Sunday allegedly helped two suspects standing trial for theft and malicious damage, to escape.

On Wednesday the Osun state police command arraigned a police prosecutor, Sergeant Sunday Ajayi, before an Osogbo Magistrate’s Court. The sergeant was brought before the presiding magistrate, A. O. Ajanaku, for negligence due to allowing the two suspects Kazeem Oladehinde and Idowu Hazzan Adedapo to escape from lawful custody.

Inspector Elisha Olusegun, a police prosecutor, told the court that the defendant and others at large conspired to commit an offense “to wit: negligently permitting the escape of the two suspects on November 1, 2017, around 5pm in Osogbo.”

He told the court that the sergeant aided the two accused standing trial before the magistrate court to escape from lawful custody, thereby committing an offense punishable under the law.

The prosecutor said the first count was punishable under Section 517, while count two was contrary to Section 137 and punishable under Section 138 of the Criminal Code, Cap 34, Volume 11, Law of Osun State, 2003.

The sergeant pleaded not guilty to the two counts and his counsel, Taiwo Awokunle, prayed the court to grant him bail.

The magistrate granted the defendant bail in the sum of N500,000 with two sureties in like sum.

She said one of the sureties must be a civil servant on Grade level 14 with the Federal Government and the second surety must have a landed property with a Certificate of Occupancy.

The case was adjourned till May 23, 2018, for hearing.
