A Chief Magistrates’ Court in Karu, Abuja, on Wednesday strike out a case of adultery for lack of jurisdiction.
The Magistrate, Muyiwa Oyeyepo, urged the police to take matter to a High Court.
The Prosecutor, Mrs Nne Okon, had told the court that in November 2013, the complainant, Innocent Chinedu, informed the court that his wife was involved in adultery.
Okon said Chinedu, who resides in Festac 22, Holy Family Church, Lagos, claimed that while he was away in Portugal, his wife, Ngozi Ugwu, who was legally married to him remarried.
He said that the complainant’s marriage to Ngozi was blessed with two children, but she concealed the marriage, remarried and forged document to change the surname of the children.
The prosecutor said that Chinedu told the court that “my wife criminally concealed our marriage and went ahead to marry one Chinedu Ugwu of Ezeagu, Enugu State.
“She also forged birth certificates of my children, changing their surnames to her father’s name, before putting them in school,’’ the prosecutor said.
He said that during police investigation, the defendant admitted that she was now married to Ugwu.
The prosecutor said the books of their two children were also discovered in her room with the forged names written on them.
He said the offences contravened Sections 388, 385 and 363 of the Penal Code.
The defendant pleaded not guilty to the charges. (NAN)
