Judge orders IGP, EFCC to release Jos-based miner from detention

The Federal High Court sitting in Jos, on Wednesday ordered the Inspector General of Police (IGP) and the EFCC to release from detention, a Jos-based miner, Alhaji Abdullahi Adamu,.

Adamu, popularly known as Dan-China, has being in detention following his arrest on April 17 by security personnel in Jos.

The miner had on April 26, instituted legal action against the IGP, the Economic and Financial Crimes Commission and three others for the enforcement of his fundament human rights over his arrest and detention.

He is claiming N1 billion as damages through his counsel, Mr Gyang Zi for what he termed violation of his fundamental human rights.

Justice Musa Kurya ordered the release of Adamu from custody pending the determination of the originating motion on notice.

The court also granted leave to the applicant to serve the originating Motion and all other processes on the 1st – 4th respondents in the case outside its jurisdiction.

While adjourning the case till May 13, the judge ordered that the detained applicant must be produce before the court on that day.

Kurya also said that the case would receive accelerated hearing.

Adamu, through his counsel, Mr Gyang Zi, had prayed for an order for his immediate release by the Police and EFCC, whom he accused of arresting and detaining him for no just cause other than serving the interest of a Chinese national.

The applicant alleged that the Police and EFCC arrested him over a case he instituted against a Chinese national at the Federal High Court, Jos, in 2013.

Adamu therefore sought the court to declare his arrest as illegal and a violation of his fundamental human right and to also order for his immediate release.

He alleged that the officials of the police and EFCC had threatened that he would rot in detention if the case against the Chinese national was not withdrawn.

Adamu expressed surprise over the turn of events whereby the complainant in fraud case was now the subject of unlawful arrest and detention at the force headquarters in Abuja.

In a 26 paragraph affidavit, Adamu, accused the IGP and EFCC of violating a court order of February and November 2014 restraining any security operatives from arresting any one related to a case between the plaintiff and a Chinese national, named Mr Zhai Feng Quan.

He alleged that Quan cheated him in a mining business amounting to N40 billion, carried out under a company, named Solid Unit Nigeria Limited located in Zurak, Wase Local Government of Plateau. (NAN)
