Justice Lewis Allagoa of a Federal High Court in Owerri has nullified the results of ward, local government and state congresses of the All Progressives Congress (APC) in Imo State.
In the judgement which lasted an hour, the judge berated the party over the congresses and ordered it to organise fresh congresses at the three levels in the state.
While dismissing a motion by the defendants over the jurisdiction of the court, Justice Allagoa affirmed that the court had jurisdiction to entertain the case.
Relying on exhibits tendered by the plaintiffs, the judge ruled that the “press interview between the state commissioner of police, the state governor, Rochas Okorocha and Senator Osita Izunaso that there was no APC ward congress in Imo State on May 5 ‘was justiciable in law.’”
Justice Allagoa also cited a report from the Independent National Electoral Commission (INEC) that no APC ward congresses held on May 5.
The judge therefore ordered the APC to be “responsible and save our democracy” by conducting fresh congresses at the ward, local government and state levels.
