Court dissolves marriage over spousal rape, battery

An Orile-Agege Customary Court on Thursday dissolved a 10-year-old marriage between one Temitope and Alilu Salaudeen over rape, battery and threat to life.
The President of the court, Mr Kayode Whenu, told the couple that their marriage had broken down irreparable.
“From today, you cease to be addressed as husband and wife. You should go your separate ways and maintain peace.
“The custody of the children remains with their mother and any contention on this should be referred to the Ikeja Family Court.

“The man is to be paying N10, 000 monthly for upkeep of the children and also be responsible for their education and medical bills,” Whenu ruled.
The News Agency of Nigeria (NAN) reports that the petitioner approached the court on Dec. 14, 2015 seeking dissolution of her marriage, citing rape, battery and threat to her life.

The petitioner, Temitope Salaudeen, 32, a trader, who resides at 2, CAC St., Agege, Lagos, had pleaded with the court to dissolve the marriage, citing rape, battery and threat to her life.

She told court that her husband was a wife-beater and treated her like a slave.
“My husband rapes me anytime he feels like having sex and does not care about my feelings or my emotions.

“He sold some of my jewelleries without my consent and steals my money at will,” she added.
Temitope said that the greatest mistake she had made in life was getting married to Alilu Saludeen.
“I ran away from the house sometime in November, 2015 with my children because if I continue living with him, he might beat me to death,” she said.

The mother of two, aged 3 and 6 years, pleaded with court to dissolve the union and grant her custody of the children.
But Alilu, 39, a building contractor, had earlier, denied all the allegations.
“I have not beaten her before, she starved me of sex for one and half years, despite the fact that we live in the same house.
“She hides her phone from me and I did not sell her jewelleries neither did I steal her money,” he said.
He pleaded with court that he was still in love with his wife and not ready for dissolution of the marriage but his plea failed to save the marriage. (NAN)
