Court Dismisses DSS Application, Grants Dasuki’s Prayers To Stay Away From Court

A Federal High Court in Abuja on Thursday, November 26, dismissed an application by the State Security Services (SSS) to order the former National Security Adviser, Sambo Dasuki to appear before it.

The judge presiding over the case, Ademola Adeniyi said his ruling is based on section 266(B) of the criminal Act which allows the defendant to stay away from the court, if there is an interlocutory application on his case.

The director of public prosecution, M. S. Diri had filed a motion on notice of the continued absence of Dasuki at three consecutive court hearings asking the court to make an order for the defendant to appear before it which was objected by the defending counsel, Joseph Daudu using the same section of the Criminal Act.

But at today’s ruling the counsels agreed on a fresh date to move a motion on revoking the bail application against Dasuki. Diri also notified the court on a counter affidavit which he intends to file.

Adeniyi however, adjourned the case to Thursday, December 3 for hearing on all matters.

The federal government had earlier filed an application for the court to revoke the bail granted the former NSA.

This comes after the court had granted permission to Dasuki to travel abroad for the treatment of cancer. But since the court’s permission, the SSS had laid siege at the Asokoro residence of Dasuki.

Dasuki is allegedly accused of money laundering, diversion of funds meant for procurement of arms during his tenure as the NSA.

While Dasuki has said he is innocent and not afraid to face the charges against him, the President Muhammadu Buhari has ordered that the former NSA be arrested.
