Justice Hanatu Balogun of the High Court in Kaduna State has given an interim order restricting Governor Nasir El-Rufai and the state’s agencies from further demolition and taking over of Durbar Hotel Plc which belongs to the family of the late Head of State, Gen Sani Abacha.
According to reports, the hotel is located along the Muhammadu Buhari Way in Kaduna state capital.
The judge issued the restraining order sequel to an ex parte motion filed by the management of the hotel through the counsel to the Abacha family, Reuben Atabor.
The motion prayed the honourable court for an order restraining El-Rufai and the Kaduna State Government agencies from “demolishing, taking over or tampering with the property”, the PUNCH reported.
It also sought an interim injunction restraining the duo from “further trespassing on the property pending the determination of the motion on notice.”

Quoting the Judge on his ruling, PUNCH said
“I grant an order restraining the defendants from taking over the property in issue and from further tampering with same or trespassing on same or developing or assigning same pending the hearing and determination of the motion on notice,” she stated in the order.
The Federal Government and the families of the late Head of State have contended over the hotel since 2001, in which the lower and appellate courts had granted judgement in favour of the family, which is now before the Supreme Court of Nigeria.
