A soldier, Lance Corporal Martins Idakpani and his wife, Victoria, have dragged the Nigerian Army before a Federal High Court for violating their fundamental human rights.

Joined as codefendants in the suit are the Chief of Army Staff, Lt.-Gen. Tukur Buratai and the Attorney-General of the Federation.

The couple is asking the court to declare as illegal the detention of Victoria last week after her husband made a viral video asking Buratai and the Chief of Defence Staff, Gen. Abayomi Olonishakin to resign over their inability to end the insurgency in the North-East.

She had been picked up days after her husband.

A lawyer, Mr Tope Akinyode, who filed the suit on their behalf, is praying the court to order the defendants to immediately release Mrs Idakpani.

In a supporting affidavit deposed to on their behalf by one Apeh Abuchi, the couple said they have not been informed of their crime since last week’s arrest and have been denied access to their lawyers.

Akinyode, in a Monday statement, described the continued detention as illegal.

Akinyode, who is the National President, Revolutionary Lawyers’ Forum, said, “We have just filed an action at the Federal High Court against the Nigerian Army, Chief of Army Staff and the Attorney of the Federation of Nigeria over the unlawful arrest and detention of Lance Corporal Martins and his Wife, Mrs Victoria Idakpini.”
