Polish Ministry: EU Has no Right to Interfere In Disciplinary Rules

Poland’s Justice Ministry, on Thursday, said the European Commission had no grounds to launch its legal action against Poland over the country’s new law on disciplining judges.

The ministry said the commission had no right because shaping the judiciary system was an exclusive competence of EU member states.

“The European Court of Justice cannot arbitrarily expand the scope of duties of member states.

“The EU’s stance is based on an untrue thesis that the law in question limits Polish judges’ right to refer questions for preliminary rulings to the EU court,’’ the ministry said.
