The Supreme Court has nullified the election of the gubernatorial candidate of All Progressives Congress (APC), Mukhtar Shehu, and other candidates elected on the platform of the party in the 2019 general election in Zamfara State.
Acting Chief Justice of Nigeria (CJN), Justice Tanko Muhammad led a five-man panel in delivering the judgement on Friday in Abuja.
The Supreme Court ruled that the first runners-up for all the posts earlier declared to have been won by the APC and its candidates during the 2019 general election should be declared the winners.
However, the court ruled that the first runners-up must fulfil the constitutional requirement of getting one quarter of the total votes cast in at least two-third of the local government areas of the state.
The apex court, in a lead judgement read by Justice Paul Galinge, upheld the ruling of the Court of Appeal sitting in Sokoto that the party did not conduct any valid primary and could therefore not have validly produced any candidate for the elections in the state.
The elections affected by the judgement include the governorship, House of Assembly and National Assembly elections.
While APC candidates won in the elections, the PDP emerged first runner-up.
