Why Femi Fani-Kayode Can’t Make Bail – Lawyer

2 Min Read

Former Aviation Minister, Femi Fani-Kayode implicated in the ex-president Goodluck Jonathan’s campaign fund scandal has continued to remain in the Economic and Financial Crimes Commission’s detention following his inability to meet the bail conditions set by the anti-graft agency.

The PDP chieftain’s counsel, Ifedayo Adedipe (SAN) yesterday explained to the court sitting in Abuja that his client can not afford the $1 million demanded by the Economic and Financial Crimes Commission as part of his bail term.

Fani-Kayode’s counsel during the hearing on the violation of fundamental rights suit filed against the EFCC by the former aviation minister said his client has only been able to meet some of the demands. He further alleged that the continuous detention of Femi Fani-Kayode is a violation of his fundamental human rights.

“The constitution anticipates that a man maybe arrested but not necessarily arraigned as provided in the Administration of Criminal Justice Act (ACJA).”

He further added: “The applicant (Fani-Kayode) has never said he did not receive the money (N800m) in question. He was the Director of Publicity for the Presidential Campaign Organisation of the former president Goodluck Jonathan who paid him the money,”

In reply, the EFCC’s counsel, Salisu Majidadi, said: “Bearing in mind the constitutional requirement of remanding the applicant, a remand order was acquired from a Magistrate Court on May 10 in Lagos which is attached to the affidavit.”

The presiding judge, Justice Olukayode after hearing the arguments from both sides adjourned the case till June 29, 2016 for judgement.
